Na condição de presidente da Ordem dos Advogados do Brasil, Seccional Sergipe, trago um alerta à sociedade sergipana que o faço com máxima urgência. Tramita no Congresso Nacional a Proposta de Emenda à Constituição (PEC) nº 66/2023, uma medida que, sob o falso pretexto de organizar as contas públicas, representa um dos mais graves ataques ao Estado Democrático de Direito das últimas décadas. Trata-se, sem eufemismos, da institucionalização do calote.
A PEC propõe adiar, por tempo indeterminado – vejam o tamanho do absurdo! –, o pagamento de precatórios. Ou seja, dívidas que o Estado tem com o cidadão após perder uma ação judicial de forma definitiva. Isso significa que uma pessoa que processou o poder público e teve seu direito reconhecido pela Justiça, após anos de espera, pode simplesmente não receber o que lhe é devido.
Essa proposta atinge em cheio o coração do nosso sistema de justiça e afeta a credibilidade do sistema jurídico. Ela viola a coisa julgada, um pilar da Constituição que garante a segurança e a estabilidade das decisões judiciais. Uma sentença judicial que não pode ser cumprida transforma-se em letra morta, esvaziando a autoridade do Poder Judiciário e rompendo o equilíbrio entre os Poderes da República.
Para além da afronta jurídica, há um custo humano devastador. Os credores de precatórios não são números em uma planilha. São cidadãos: idosos que aguardam recursos para custear medicamentos, pessoas com doenças graves que dependem desse dinheiro para tratamentos, famílias que esperam por uma indenização para garantir o seu sustento. Adiar o pagamento desses direitos é condenar os mais vulneráveis a uma espera que, para muitos, pode ser mais longa que a própria vida.
A PEC 66/2023 também consagra uma profunda injustiça. Ela cria uma inaceitável desigualdade: o Estado, que exige e cobra do cidadão o pagamento de impostos em dia sob pena de multas e juros severos, concede a si mesmo o privilégio de, “ao bel-prazer” e com voluntarismo, não honrar suas próprias dívidas e compromissos. É a subversão da isonomia, princípio que dita que todos são iguais perante a lei. Se o Estado cobra em dia, tem o dever moral e legal de também pagar em dia.
Não podemos aceitar este retrocesso! A OAB, em uma frente unida que inclui o Conselho Federal, sob a liderança do presidente Beto Simonetti, e todas as 27 seccionais, repudia veementemente esta proposta. A Ordem mobilizará a bancada sergipana e se unirá às entidades de classe do país nesta luta. A advocacia e a sociedade sergipana exigem respeito às decisões judiciais e à dignidade do cidadão. A luta contra a PEC 66/2023 é a luta pela preservação da justiça e da própria cidadania.
