A Ordem dos Advogados do Brasil – Seccional Sergipe (OAB/SE) solicitou a impugnação do edital do concurso público nº 01/2025, destinado ao preenchimento de cargos no quadro efetivo da Câmara Municipal de Ribeirópolis/SE. Graças a um acordo administrativo, o edital foi alterado para corrigir irregularidades, especialmente relacionadas ao piso salarial da advocacia em Sergipe.
De acordo com a Lei nº 8.906/1994 (Estatuto da Advocacia e da OAB), a participação da OAB é obrigatória em todas as fases de concursos públicos para cargos que exigem inscrição na Ordem, incluindo a elaboração do edital. No entanto, essa participação não ocorreu na elaboração do certame em questão.
Outro ponto importante é que o edital previa uma remuneração de R$ 3.995,00 para o cargo de Procurador Legislativo, com carga horária de 30 horas semanais. Essa remuneração contrariava o piso salarial da advocacia no Estado de Sergipe, estabelecido pela Lei Estadual nº 8.241/2017 e atualizado pela Portaria nº 024/2025-GP-OAB/SE, que define R$ 2.949,60 para 20 horas semanais e R$ 5.899,19 para 40 horas semanais.
Proporcionalmente, a remuneração para 30 horas semanais deveria ser de aproximadamente R$ 4.424,39, valor superior ao previsto no edital.
Diante dessas irregularidades, a OAB/SE entrou com um pedido de impugnação dentro do prazo legal. Reconhecendo os erros, a Câmara Municipal de Ribeirópolis realizou a retificação do edital, atendendo às solicitações da Ordem.
“Solicitamos a retificação do Edital nº 01/2025 para ajustar o salário previsto para a carreira jurídica de advogado inscrito na OAB e a carga horária, garantindo uma remuneração justa, conforme a Lei do Piso da Advocacia, atualizada pela Portaria nº 024/2025-GP-OAB/SE. Fixar uma remuneração abaixo do piso configura violação à norma legal, prejudicando a dignidade da função advocatícia no serviço público e desestimulando a participação de profissionais qualificados no certame”, afirmou o procurador-geral Leonardo Oliveira.
