Atendendo a determinação do Conselho Nacional de Justiça, o Tribunal de Justiça de Sergipe inaugurou, na última quinta-feira, 21, o Núcleo de Garantias no Fórum Gumersindo Bessa, em Aracaju, com o objetivo de colocar em prática a implantação do juiz de garantias.
Instituído pela Lei Federal nº 13.964/2019, o chamado Pacote Anticrime, o juiz de garantias tem a atribuição de acompanhar a fase investigativa do processo penal, fiscalizando a legalidade das apurações e protegendo os direitos individuais dos investigados. A medida busca garantir maior imparcialidade, já que o mesmo magistrado que analisa a legalidade das provas não poderá ser o responsável pelo julgamento do caso.
Em Sergipe, o Núcleo de Garantias foi criado pela Lei Complementar nº 433, de 8 de maio de 2025. Ele é composto pelas juízas Jumara Pinheiro e Lidiane Andrade, além do representante do Ministério Público, promotor João Rodrigues, que está momentaneamente sendo substituído pela promotora Ana Leila Costa Garcez.
Audiências de Custódia
Com a criação do Núcleo, as audiências de custódia passam a ser realizadas diariamente, de segunda a sexta-feira, a partir das 10h, sendo realizadas de forma alternada pelas magistradas responsáveis. Nos finais de semana e feriados, as audiências serão conduzidas em regime de plantão.
Em relação ao exame de corpo de delito dos investigados, o local de realização do exame ainda será confirmado pelo Tribunal de Justiça.
O presidente da Comissão Especial de Advocacia Criminal da OAB/SE, Sandro Leonel de Araújo, destacou o papel da advocacia na implementação. “É um avanço importante para o sistema judiciário ter um juiz de garantias atuando na fase pré-processual, porque haverá a separação das competências. O juiz de garantias atuará apenas na fase investigativa, enquanto outro juiz será responsável pelo julgamento após o recebimento da denúncia. Nós, da Comissão, acompanharemos presencialmente a implantação do Núcleo durante os próximos 60 dias, prestando suporte e atendimento à advocacia nas demandas relacionadas”, afirmou.
