OAB pede ao STF a conclusão de inquéritos de natureza perpétua

O Conselho Federal da OAB e o Colégio de Presidentes dos Conselhos Seccionais enviaram, nesta segunda-feira (23/2), ofício ao Supremo Tribunal Federal (STF) solicitando a conclusão de inquéritos de natureza expansiva e duração indefinida, em especial o Inquérito nº 4.781, conhecido como o inquérito das Fake News. No documento, a entidade também requer que não sejam instaurados novos procedimentos com conformação semelhante.

No ofício encaminhado ao presidente do STF, ministro Edson Fachin, a OAB manifesta “extrema preocupação institucional com a permanência e conformação jurídica de investigações de longa duração, em especial do Inquérito n.º 4.781”. A entidade ressalta que o procedimento “nasceu em contexto excepcional” e que, justamente por isso, “sua condução e permanência no tempo reclamam cautela ainda maior, com estrita observância da excepcionalidade que lhe deu origem e dos limites constitucionais que legitimam a atuação estatal”.

A OAB reafirma, contudo, seu reconhecimento ao papel desempenhado pelo STF na defesa da ordem constitucional e da estabilidade democrática. Ao mesmo tempo, enfatiza que “a defesa da democracia não se esgota na repressão a ataques institucionais; ela se completa com a observância estrita do devido processo legal, da ampla defesa, do contraditório e da liberdade de expressão”.

O ofício, apresentado em manifestação conjunta da Diretoria Nacional e dos Presidentes dos Conselhos Seccionais, também destaca a necessidade de proteção às garantias constitucionais da atividade jornalística e às prerrogativas da advocacia. Segundo o documento, “a advocacia não pode atuar sob ambiente de incerteza quanto aos limites da atuação investigativa estatal, sobretudo em temas que envolvam sigilo profissional, acesso a dados e preservação da confidencialidade da relação entre defensor e constituinte”. A Ordem acrescenta que “acessos ilegais, obtenção indevida e vazamentos de dados sigilosos de cidadãos são condutas absolutamente inaceitáveis e merecem apuração rigorosa e punição exemplar”.

A OAB requer, ainda, “que sejam adotadas providências voltadas à conclusão dos chamados inquéritos de natureza perpétua”, bem como a designação de audiência institucional para apresentação de contribuições da advocacia brasileira sobre o tema.
