Justiça proíbe “lan house” de prestar assessoria previdenciária de forma ilegal

Em uma importante vitória para a proteção da sociedade e da advocacia, a 1ª Vara Federal de Sergipe acolheu pedido da Ordem dos Advogados do Brasil – Seccional Sergipe (OAB/SE) e determinou, em caráter liminar, a suspensão imediata das atividades ilegais praticadas pela empresa “FC Lan House” e por seu sócio, conhecido como “Cosminho Galego”. Eles vinham oferecendo serviços de consultoria e assessoria previdenciária sem registro na Ordem, configurando exercício ilegal da profissão.

Segundo consta nos autos (processo nº 0012608-88.2025.4.05.8500), a empresa atuava em diversas cidades sergipanas – como Aracaju, Estância e Itabaiana – abordando indevidamente clientes em frente a agências do INSS, além de divulgar seus serviços por meio de publicidade ostensiva nas redes sociais. Também foram identificadas cobranças de honorários em desacordo com a tabela da OAB/SE. A atuação de pessoas não habilitadas é vedada pelo Estatuto da Advocacia e configura crime.

Para o presidente da OAB/SE, Danniel Costa, o combate a essa prática é uma prioridade da instituição. “Nosso objetivo é, sobretudo, proteger o cidadão de danos muitas vezes irreparáveis”, afirma. A decisão reconheceu o risco à população e determinou a remoção de todo o conteúdo publicitário da empresa, bem como o encaminhamento dos clientes já captados a advogados regularmente inscritos ou à Defensoria Pública.

Danniel alertou ainda para os riscos envolvidos nesse tipo de atendimento. “O Direito Previdenciário é uma área técnica e em constante atualização. Um leigo pode cometer erros que resultem em benefícios negados ou aposentadorias com valores inferiores aos devidos. E o pior: a perda de prazos pode comprometer de forma definitiva os direitos do cidadão”, explica.

O presidente também destacou a ausência de garantias para quem recorre a serviços prestados por pessoas não habilitadas. “O advogado responde civil e eticamente por seus atos, sendo fiscalizado pela OAB. Já o praticante ilegal não oferece nenhuma dessas garantias. Se houver erro, o cidadão dificilmente será ressarcido. Além disso, a relação com o advogado é protegida por sigilo profissional, algo que inexiste nessas práticas irregulares”, completa.

Além dos prejuízos à população, a OAB/SE também alerta para os danos à própria advocacia. “Essa prática configura concorrência desleal, avilta os honorários e compromete a imagem da nossa classe, ao transmitir a falsa ideia de que a habilitação profissional é dispensável”, observa Danniel Costa que conclui reafirmando o compromisso da Ordem com a defesa da legalidade e da segurança jurídica.

“A decisão judicial reforça o papel indispensável da advocacia na proteção dos direitos da população. Continuaremos atuando com firmeza contra qualquer prática ilegal que comprometa a ética, a qualidade técnica e a confiança da sociedade nos profissionais da advocacia”, afirma.

A atuação da OAB/SE reuniu esforços da Coordenação Estadual de Fiscalização da Atividade Profissional da Advocacia, dos presidentes das regionais e também da Procuradoria-Geral, com a apuração dos fatos e provas.
