Com atuação da OAB/SE, TJ/SE reconhece dano moral presumido em benefícios previdenciários

O Tribunal de Justiça de Sergipe (TJSE) reconheceu, de forma favorável à advocacia e à sociedade, em caráter vinculante, o dano moral presumido nos casos de descontos indevidos em benefícios previdenciários ou em contas bancárias de seus titulares. O julgamento do Incidente de Resolução de Demandas Repetitivas (IRDR) aconteceu nesta quinta-feira, 25.

A Ordem dos Advogados do Brasil – Seccional Sergipe (OAB/SE) atuou como amicus curiae no IRDR e fez sustentação oral em defesa dos direitos dos aposentados e pensionistas de serem indenizados moralmente quando vítimas de descontos indevidos praticados por associações.

“A decisão representa uma grande vitória não apenas para a advocacia, mas principalmente para a sociedade, em especial para aposentados e pensionistas que vinham sofrendo descontos indevidos em seus benefícios. A OAB, como amiga da Corte, fez a sustentação oral defendendo o direito dos consumidores, com base em relatórios e pareceres técnicos elaborados pelas Comissões de Defesa dos Direitos do Consumidor e de Direito Previdenciário da OAB/SE. Esse trabalho conjunto reforça o compromisso da Ordem com a proteção da cidadania e a garantia do respeito à dignidade dos beneficiários do INSS”, afirma o procurador-geral da OAB/SE, Leonardo Oliveira.

O presidente da Comissão de Direito Previdenciário da OAB/SE, Ramon Cavalcante, ressaltou que a decisão representa uma reparação para os beneficiários do Instituto Nacional do Seguro Social (INSS) vítimas de fraudes e descontos indevidos.

“A decisão de hoje é uma verdadeira vitória para os aposentados e pensionistas do INSS. Trata-se de uma reparação justa, pois essas pessoas, muitas vezes em situação de extrema vulnerabilidade, tiveram seus proventos comprometidos de forma ilegal. Agora, com o reconhecimento do dano moral presumido, há uma proteção efetiva e um avanço significativo na defesa da dignidade desses beneficiários”, enfatiza.

A decisão também foi comemorada pelo presidente da Comissão de Defesa dos Direitos do Consumidor da OAB/SE, Frank Deering. “Hoje, toda a coletividade, em especial os consumidores, tem motivos para se sentir mais satisfeita e segura, já que o julgamento reconheceu o dano moral presumido e garantirá a efetiva proteção de seus direitos daqui para frente. Parabenizo a OAB/SE pela atuação firme e combativa nesse processo. Quem ganha com essa conquista é toda a sociedade sergipana”, finaliza.
